Sa 70-pahinang Motion for Reconsideration, hinimok nito si Judge Liezel Aquitan na pag-aralan ang nauna nitong desisyon.
“This Motion for Reconsideration, therefore, is being submitted in order to give the Honorable Court the opportunity, not just to revisit the Omnibus Order or the merits of the motions filed by Accused De Lima (one of which was even erroneously referenced as a Petition for Bail’ and not referenced even once), but also the entire records of the case,” ang nakasaad sa mosyon.
Inakusahan nito ang hukom ng ‘cherry picking’ dahil 20 pahina sa 35 pahinang Omnibus Order nito ay nakatuon sa pahayag ng panig ng prosekusyon.
“Worse, not a single reference is made to a single paragraph of Accused De Lima’s Motion for Bail ad Cautelam, which was even referenced several times in the Accused’s later-filed Demurrer to Evidence,” sabi pa ng senadora.
Muli ding ipinagdiinan ng senadora na walang katotohanan ang mga naging testimoniya ni dating BuCor OIC Rafael Ragos kaugnay sa pagdadala nito ng pera sa senadora.
Aniya, walang matibay na ebidensiya sa susuporta sa pahayag ni Ragos.
