P600-M tax case laban sa Puregold Duty Free, ibinasura ng Korte Suprema
Ibinasura ng Korte Suprema ang 6.6 billion pesos na halaga ng tax case na inihain ng Bureau of Internal Revenue laban sa Puregold Duty Free Incorporated na pag-aari ng negosyanteng si Lucio Co dahil sa umano’y hindi nabayarang ‘sin’ taxes gaya ng Excise tax at Value Added Tax.
Sa desisyon ng Supreme Court 3rd Division, ibinasura nito sa botong 3-2 ang reklamo laban sa Puregold dahil ito umano ay saklaw ng tax amnesty at exempted sa buwis dahil ang negosyo niyang Puregold Duty Free ay nasa loob ng Clark Economic Zone.
Matatandaan na November 7, 2005 nang mag-isyu ang BIR ng Preliminary Assessment Notice kaugnay ng hindi nabayarang VAT at excise tax ng Puregold dahil sa mga inangkat nitong alak at sigarilyo mula January 1998 hanggang May 2004.
Sa desisyon na isinulat ni Associate Justice Presbitero Velasco Jr, ibinasura ng Korte Suprema ang petisyon ng BIR at kinatigan ang May 9, 2012 Decision at July 18, 2012 Resolution ng Court of Tax Appeals na pabor sa Puregold.
Salig umano sa Executive Order 80 na nagtatakda ng tax incentive at duty free priveleges sa mga negosyong nag-ooperate sa Clark Economic Zone, ang Puregold ay libre sa pagbabayad ng buwis para sa mga inangkat nito.
Noong July 27, 2007, naghain din ang Puregold ng tax amnesty sa ilalim ng Republic Act 9399 o batas na naggagawad ng one time tax amnesty sa mga negosyong nasa Economic Zone o Freeport.
