Pagbasura sa DQ case vs Erwin Tulfo pinagtibay ng Comelec
Walang nakitang basehan ang Commission on Elections (Comelec) en banc para baligtarin o baguhin pa ang naunang pagbasura sa disqualification case laban kay ACT-CIS Party-list nominee Erwin Tulfo.
“While it is true that application of technical rules of procedure may be relaxed to better serve the ends of substantial justice, there is nothing in this case that would justify the non-compliance of the Petitioner with the rules,” ang mababasang bahagin ng dalawang pahinang resolusyon.
Nabanggit din na lagpas na sa “prescribed period” ang paghahain ng motion for reconsideration ng nag-petisyon na si Atty. Moises Tolentino Jr.
Una nang ibinasura ang petisyon ni Tolentino ng Comelec 2nd Division noong Mayo sa katuwiran na wala na ito sa hurisdiksyon ng komisyon.
Si Tulfo ang 4th nominee ng ACT-CIS at umangat siya ng magbitiw si dating Rep. Jefferson Soriano, ang second nominee.
Nakasaad din sa resolusyon na ang pagkuwestiyon sa kuwalipikasyon ni Tulfo na maupo bilang kinatawan ng ACT-CIS ay nasa kamay na ng House of Representatives Electoral Tribunal.
