Pang-aabuso sa ‘substitution rule’ ng Comelec nais matigil ni Sen. Leila de Lima

Naghain ng panukala si Senator Leila de Lima upang matuldukan na ang pang-aabuso sa batas kaugnay sa ‘substitution of candidates’ sa mga national at local elections.

Sa inihain niyang Senate Bill No. 2461 nais ni de Lima na napagtibay sa lehislatura ang polisiya ng Comelec ukol sa substitution.

Nais ng namumuno sa Senate Committee on Social Justice na ang pagpapalit ng kandidato ay malimitahan na lamang sa kamatayan at diskuwalipikasyon.

“The Omnibus Election Code recognizes the importance of our party system and our political parties and therefore provides for an opportunity for political parties to replace their candidates before the elections,” diin ng senadora.

Sa kanyang panukala, nais ni de Lima na maamyendahan ang Section 77 ng Omnibus Election Code at maipatupad ang naging pagbabago sa Section 12 ng Fair Elections Act.

Binanggit ni de Lima ang ginagawa ng ilang partido na magpatakbo ng mga wala naman intensyon makilahok sa kumandidato at kinalaunan ay papalitan ng kanilang tunay na kandidato.

“In order to prevent this from happening, the COMELEC should be able to determine whether these ‘placeholders’ are nuisance candidates in spite of substitution, which, in turn would void the substitution by the political party which nominated them,” aniya.
