Contempt case na ikinasa laban sa kanya ipinababasura ni Sen. Leila de Lima

Hiniling ni Senator Leila de Lima at ng kanyang abogadong si Boni Tacardon sa isang korte sa Muntinlupa City na ibasura na ang contempt case na isinampa laban sa kanila ng panig ng prosekusyon.

Sa inihain nilang magkahiwalay na komento noong Lunes, iginiit nina de Lima at Tacardon  na nararapat lang na ibasura ang petisyon ng prosekusyon dahil ang kanilang mga pahayag ay hindi naman maituturing na panganib sa paggagawa ng hustisya.

“In the words of the Prosecution themselves, what they only fear is that the said ‘statements’ will ‘pursuade, influence, intimidate, incite perception and sentiments of their colleagues and other government officials, including the trial court judges,’” sabi ni Tacardon.

Dagdag pa niya, ang petisyon laban sa kanila ay hindi naman direktang nakatuon sa Korte at wala din katibayan na naimpluwensiyahan si Judge Liezel Aquiatan.

“ The Omnibus Orders issued by Aquiatan on Feb. 17 are best proof that there was never any clear and present danger, or imminent threat to the administration of justice occasioned by her comments,” sabi naman ni de Lima.

Kamakailan  lang pinaboran ng korte ang demurrer to evidence petition na inihain ni de Lima para sa isa sa tatlong drug cases na isinampa laban sa kanya.

Kasabay nito, ipinaliwanag din ni de Lima na hindi masasabing ganap ang rule on sub judice, “the sub judice rule puts limits on what may be considered as fair reporting of an ongoing court case of public interest.”

Dagdag pa niya, “ it is not intended to gag public interest in or public comment on a public trial, more specifically a criminal trial or a case involving public interest. These kinds of court proceedings are a public event, and what occurs in the courtroom is public property.”

Sinabi din ni Tacardon na ipinagtataka nila ang pahayag ng prosekusyon na nilabag nila ang sub judice gayun sila din ay nagsasalita sa media kaugnay sa mga kasong kinahaharap ng senadora.
