WATCH: Duterte hindi maaring arestuhin ng ICC

Ito ang naging bwelta ng Palasyo ng Malakanyang sa pahayag ni dating congressman at National Union of People’s Lawyer chairman Neri Colmenares na maaring maaresto si Pangulong Rodrigo Duterte kapag natapos na ang imbestigasyon ng International Criminal Court (ICC) kaugnay sa crimes against humanity na kinakaharap ng Punong Ehekutibo dahil sa madugong kampanya kontra sa ilegal na droga.

Sa panayam ng Radyo Inquirer, sinabi ni Presidential spokesman Salvador Panelo na matagal nang hinahangad ni Colmenares na makulong ang pangulo.

Walang epekto aniya ang pag-iisyu ng warrant of arrest ng ICC dahil sa una pa lamang wala namang hurisdiksyon sa Pilipinas.

Kung sakali man aniyang may hurisdiksyon ang ICC sa Pilipinas, matagal pa bago maaresto ang pangulo.

Paliwanag kasi ni Panelo, sa ngayon ay nasa preliminary examination pa lamang ang ICC at dadaan pa sa preliminary investigation.

“Wish lang ‘yun ni Cong. Colmnares ‘yan ang fervent wish, ‘di mangyayari yun., walang jurisdiction ang ICC, so ineffective ang pag-isyu pa ng warrant, paano nila i-enforce. Isa pa hindi naman ganun kadali, may preliminary examination to do that tapos they will determine kung may acquire ng jurisdiction number 2 preliminary investigation to determine kung may probable cause or not. ‘Pag meron na saka sila magta-trial. So matagal pa ‘yan assuming na may jurisdiction eh wala nga as far as we are concern,” ani Panelo.
