Del Rosario, Morales kumpyansa sa tagumpay ng kaso laban kay Xi

Kumpyansa sina dating DFA Sec. Albert Del Rosario at dating Ombudsman Conchita Carpio-Morales na magtatagumpay ang crimes against humanity na inihainin nila sa International Criminal Court (ICC) laban kay Chinese President Xi Jinping.

Positibo sina Del Rosario at Morales na may kahihinatnan ang kaso kahit hindi miyembero ng ICC ang China.

“What we’re talking here is crime committed within the territory of a state party. The one who committed the crime does not have to belong to a country who is a state party or member to the ICC. Since we filed the communication at a time the Philippines was still a state party to the Rome Statute, then we have jurisdiction over Mr. Xi because he committed the crime within Philippine territory,” pahayag ni Morales sa press conference sa Makati City araw ng Biyernes.

Bukod kay Xi, inireklamo ng dalawang dating opisyal sina Foreign Minister Wang Yi at Chinese Ambassador to the Philippine Zhao Jianhua kaugnay ng pag-angkin ng China sa South China Sea.

Ayon kina Del Rosario at Morales, responsable ang mga opisyal ng China sa pagkasira at pagkawala ng marine environment at yamang dagat sa naturang teritoryo dahil sa itinayong mga artipisyal na isla, militarisasyon at iba pang aktibidad.

Ayon kay Del Rosario sakaling ipaaresto ng ICC si Xi pero balewalain niya ito, hindi ito makakapunta sa 123 na miyembro ng international court.

Pwede anyang pwersahin ng 123 state parties si Xi at mga opisyal nito na bumalik sa Hague at harapin ang mga reklamo laban sa kanila.

Sinabi naman ni Morales na hindi dapat maduwag ang mga otoridad kung tama ang ipinaglalaban.

Hindi anya dapat makasagabal ang kapangyarihan at impluwensya sa rule of law.

Inihalintulad pa ni Morales ang kaso laban kay Xi sa laban ni David kay Goliath.

“We demand accountability. We want to check impunity,” ani Morales.
