Pagpapataw ng buwis sa health card premiums tinutulan ng mga senador
Tinutulan ng mga senador ang anila’y invalid na utos ng Bureau of Internal Revenue na patawan ng buwis ang health card premiums.
Ayon kay Senador Chiz Escudero, tanging ang Kongreso at hindi ang BIR ang may kapangyarihan na magpataw ng buwis.
Wala anya sa Tax Reform for Acceleration and Inclusion (Train) law na nagsasaad na nais ng Kongreso na buwisan ang premium sa health card o mga HMO.
Panghihimasok aniya ang Revenue Memorandum Circular 50-2018 sa kapangyarihan ng Kongreso kaya invalid ito.
Ito rin ang posisyon ni Senate President Pro Tempore Ralph Recto na nagsabing wala sa batas na may buwis ang health card premiums.
Ang dapat anyang ipatupad ng BIR ay ang probisyon ng batas na exemption o walang value added tax ang maintenance drugs para sa sakit sa puso at diabetes simula sa Enero.
Nais naman ni Senador Sonny Angara, chairman ng Senate committee on ways and means, na bawiin ng BIR ang utos nito.
Sa ilalim ng BIR memo, ang premium sa health card na binabayaran ng employer para sa mga empleyado ay isasama sa bonus at benepisyo na subject sa P90,000 tex-exempt threshold.
