CA kinatigan ang ruling ng SEC laban sa Rappler

Pinaboran ng Court of Appeals (CA) ang naunang order ng Securities and Exchange Commission (SEC) na i-revoke ang articles of registration ng online news website na Rappler dahil sa paglabag sa Saligang Batas kung saan nakasaad na dapat ang isang media company ay 100% Filipino owned.

Sa 72 pahinang desisyon ni Associate Justice Rafael Antonio Santos ng Special 12th Division ng CA, nakasaad na sa ilalim ng foreign equity restriction on mass media ay dapat na walang kahit anumang foreign control ang isang media company, kabilang na dito ang anumang “appearance of control.”

Nakitaan din ng CA ng kontrol ang Omidyar Network Fund sa Rappler batay sa clause 12.2.2 ng Omidyar Philippine Depositary Receipts kung saan nakasaad na ang karapatang bumoto para sa shares ng Rappler ay pinaghahatian nila ng Rappler Holdings Corporation.

Ayon pa sa CA, binigyan ng SEC ang Rappler ng due process, taliwas sa sinabi ng Rappler na hindi sila pinagbigyan ng ahensya.
