Smartmatic pumuntos vs Comelec sa Supreme Court

Pinaboran ng Korte Suprema ang petisyon ng Smartmatic na kumuwestiyon sa pagdiskuwalipika sa kanila ng Commission on Elections (Comelec) sa bidding sa election-related projects.

“The SC granted the petition. It held that Comelec committed grave abuse of discretion when it disqualified Smartmatic before it had submitted any bid, without any reference to the eligibility requirements prescribed by its BAC (Bids and Awards Committee). It implemented a discretionary pre-qualification regime antithetical to the Government Procurement and Reform Act,” sabi ni SC spokesperson Camille Sue Mae Ting.

Gayunpaman, hindi naibasura ang pagbibigay ng Comelec ng kontrata sa Miru Systems para sa vote counting machines (VCMs) na gagamitin sa 2025 midterm elections.

Si Associate Justice Jose Midas Marquez ang sumulat ng desisyon.

Noong nakaraang Nobyembre diniskuwalipika ng Comelec ang Smartmatic sa public bidding para sa VCMs dahil sa mga alegasyon ng iregularidad, kasama si dating Comelec Chairman Andres Bautista.

Bunga nito, naghain ang Smartmatic ng petisyon sa Korte Suprema ang kinuwestiyon ang desisyon ng Comelec.

Sa naging desisyon, maari nang makibahagi ang Smartmatic sa mga darating na eleksyon sa bansa.
