MPT-South sinagot ang inihain na mandamus ng PEATC
Binigyang-linaw ng MPT South Management Corporation ang kanilang posisyon hinggil sa mandamus na inihain ni PEA Tollway Corporation (PEATC) ng Philippine Reclamation Authority (PRA).
Sa inilabas na pahayag ng MPT South ang operasyon at maintenance ng Manila-Cavite Toll Expressway (Cavitex) ay responsibilidad ng PEATC, gayundin ang 485 regular employees at contract personnel.
Sinabi pa ng MPT South na ang kanilang responsibilidad ay sa disenyo, finance at construction base sa joint venture agreement (JVA).
Dapat ayon pa sa MPT South ang mga reklamo ukol sa operasyon ng Cavitex ay idinudulog at sinasagot ng PEATC.
Nabatid na wala din maituturing na PEATC Board of Directors dahil walang naitalagang mga miyembro nito bunga naman ng isyu sa GOCC Governance Commission.
Bahagi ng MCTEP project ang R1 (7.5 Km), R1 Extensions (8.6Km); Cavitex-C5 (7.7 km) o kabuuang 23.8 kilometro.
Bukod pa dito ang Cavitex – C-5 Link na sakop ang mga lungsod ng Parañaque, Pasay at Taguig na may madadaaan ng 50,000 sasakyan kada araw at magpapaluwag sa Roxas Boulevard, MIA Road at EDSA.
Giit pa ng MPT South na walang awtoridad si PEATC officer-in-charge Dioscoro Esteban Jr. na maghain ng mandamus sa Court of Appeals ng walang pag-apruba ng Board of Directors na wala naman ang naturang ahensiya.
Bukod pa dito ang mga partido sa kasunduan ay ang PRA, Cavitex Infrastructure Corp. (CIC) at Toll Regulatory Board kayat sinasabing panloloko ang intensyon ni Esteban.
“We believe that, based on the advice of our lawyers, the case should be dismissed outright by the Court of Appeals because of a false and defective verification and certification and something as basic as filing the mandamus without proper authority of the PEATC or PRA Board and without the sign-off of the proper counsel OGCC,” ayon pa sa MPT South.
