Ibinasura ng Sandiganayan ang mosyon ni dating Quezon City Mayor Herbert “Bistek”Bautista na ibasura na ang kinahaharap na kasong katiwalian.
Ang kaso ay may kaugnayan sa P32-million Information and Communications Technology sa pamahalaang-luingsod noong 2019.
Sa 23-pahinang resolusyon ng Sandiganbayan 7th Division ibinasura ang motions for leave to file demurrer to evidence na inihain ni Bautisrta at City Aministrator, Aldrin Cuña.
“At this stage, the claims and defenses of the accused of the evidence presented by the prosecution are not yet weighed in. They are best left until the presentation of the defense evidence where both accused shall have the opportunity to refute the evidence presented against them,” ayon sa korte.
Unang tinanggap ng korte ang documentary evidence na inihain ng Office of the Ombudsman’laban kina Bautista at Cuña sa proyekto na para sa online occupational permitting and tracking system project.
Itinakda naman sa Marso 20 ang paghahain ng panig ng depensa ng kanilang mga ebidensiya.
