Pagbasura ng SC sa 2005 joint-oil exploration deal sa SCS pinagtibay

Idineklara ng Korte Suprema na pinal na ang desisyon na nagdeklarang labag sa 1987 Constitution ang  2005 Tripartite Agreement for Joint Marine Seismic Undertaking (JMSU) sa pagitan ng China National Offshore Oil Corporation (CNOOC), Vietnam Oil and Gas Corporation (PETROVIETNAM), at Philippine National Oil Company (PNOC) sa isang bahagi ng South China Sea.

Base sa inilabas na resolusyon, ibinasura ng Korte Suprema ang motion for reconsideration na inihain ng Department of Foreign Affairs(DFA), Department of Energy (DOE), Philippine National Oil Company(PNOC), at PNOC Exploration Corporation.

Isinulat ni Associate Justice Samuel H. Gaerlan, ang sumulat ng naunang desisyon nong Enero 2023.

Magugunita na ang petisyon laban sa kasunduan ay inihain noong pang Mayo 2008 nina Bayan Muna Party-List Reps. Satur  Ocampo at Teodoro Casino, Anakpawis Rep. Crispin  Beltran, Gabriela Women’s Party Reps. Liza Maza at Luzviminda Ilagan, at Reps. Lorenzo Tafiada III at Teofisto  Guingona III.

Itinuring na paglabag sa Saligang Batas ng Pilipinas ang kasunduan dahil mayorya ng mga magsasagawa ng eksplorasyon ay mga kompaniya na pag-aari ng mga banyaga.
