Taguig City nanindigan na hindi kailangan ng “Writ of Execution” sa SC decision

Naninindigan ang pamahalaang-lungsod ng Taguig na hindi na kailangan pa ng “writ of execution” para mailipat sa kanila ang hurisdiksyon ng 10 barangay na nasakop ng naunang desisyon ng Korte Suprema.
“The Supreme Court decision is self-executing. Government agencies have voluntarily complied comfortably to law. Taguig does not neeed a Writ of Execution to exercise jurisdiction over Fort Bonifacio Military Reservation consisting of parcels 3 and 4 of PSU – 2031,” giit ng pamahalaang-lungsod ng Taguig City Sinabi din na malinaw naman ang “dispositive portion” ng pinal na desisyon ng Kataastaasang Hukuman, kung saan sinabi na ang 10 barangays ay pag-aari ng Taguig City. Naging permanente na rin ang preliminary injunction na inilabas ng isang korte sa Pasig City na nagbawal na sa Makati LGU na magpatupad ng mga pagbabago sa mga barangay. “These two dispositions are self-executing. The nature and tenor of the permanent injunction against Makati do not require a writ of execution for the decision to be implemented. The 10 barangays within Parcels 3 & 4 have been confirmed and declared as within the territory of Taguig. It is final and executory,” diin ng Taguig LGU. Bunga din ng desisyon, awtomatikong nawala ang awtoridad ng Makati LGU sa 10 barangay at nailipat na sa Taguig LGU. Idiniin din na dapat ay tumalima sa batas ang Makati LGU bilang isang political unit at sumunod sa mga legal na kautusan. “For the officials of Makati to continue to assert jurisdiction over the EMBOs is to violate not only their oaths, but also Section 2 of their very own Charter, as well as the laws on public officers. More than being a party to the case, immediate compliance with the Supreme Court Decision is demanded not just by their oaths as public servants but by the laws of the Philippines,” saad pa sa pahayag.
