Prosecutors sa drug case ni de Lima hiniling ang pagbitaw ng hukom

Hiniling ng mga taga-usig ng Department of Justice (DOJ) kay Muntinlupa City Regional Trial Court (RTC) Judge Abraham Joseph  Alcantara na bitawan nito ang natitirang drug case ni dating Senator Leila de Lima.

Sa inihain nilang mosyon kahapon, ikinatuwiran ng panel of prosecutors na si Alcantara ang nagpawalang-sala kay de Lima sa kinharap ng huli na Criminal Case No. 17-165.

“Having adversely decided against the People in the previous Criminal Case No. 17-165, the undersigned Panel of Prosecutors cannot help but be apprehensive that the Honorable Presiding Judge will carry over his perceptions to the instant case,” ayon sa panel sa kanilang mosyon.

Dagdag pa nila, makakabuti na mag-inhibit ang hukom upang hindi pagdududahan ang paghawak niya sa kaso.

Binanggit din nila ang  Section 1, Rule 137 ng Rules of Court kung saan nakasaad na ang isang hukom ay maaring mag-inhibit base sa mga makatuwirang kadahilanan.

Ang Criminal Case No. 17-167, ang huling druig case ni deLima ay unang hinawakan ni Judge Romeo S. Buenaventura ng RTC Branch 256, ngunit nag-inhibit ito base sa mosyon ng kampo ng dating senadora.
