Drug case laban kay Col. Marcelino ibinasura ng DOJ

Dinismis ng Department of Justice (DOJ) ang kasong kriminal na inihain ng Philippine Drugs Enforcement Agency (PDEA) laban kay Marine Colonel Ferdinand Marcelino at sa informant at asset na Chinese national na si Yan Yi Shou.

Matatandaang si Marcelino ay inaresto ng mga tauhan ng PDEA at Anti Illegal Drugs Group ng Philippine National Police (PNP) noong January 21 sa pagsalakay na ikinasa ng mga awtoridad sa isang townhouse sa Sta. Cruz, Maynila.

Si Marcelino ay ipinagharap ng reklamong paglabag sa Section 11 at 26 ng Republic Act 9165 o Comprehensive Dangerous Drugs Act na tumutukoy sa manufacturing, possession and conspiracy in the manufacturing of illegal drugs at paglabag sa election gun ban matapos makumpiskahan ng baril ng walang kaukulang dokumento.

Pero batay sa 16-pages resolution ng DOJ na pirmado ni Senior Deputy State Prosecutor Theodore Villanueva, hindi nakitaan ng probable cause ang reklamong inihain laban kay Marcelino.

Nakasaad pa sa resolusyon na bago at matapos ang issuance ng search warrant sa townhouse, hindi nakita sina Marcelino at Yan Yi Shou sa casing at surveillance operation.

Malinaw din na nakasaad ang search warrant sa mga pangalang Lo Chi, Atong Lee at isang nakilala lamang sa pangalan na Chu.

Dahil dito, nasuportahan umano ni Marcelino ang pahayag nito na first time niyang nakapunta sa townhouse matapos makatanggap ng impormasyon na mayroong drug operation sa lugar.
