Drug case ni Kerwin Espinosa ibinasura ng korte sa Makati City
Pinawalang-sala ng isang korte sa Makati City si Kerwin Espinosa sa kinaharap nitong drug trafficking.
Pinagbigyan ni Judge Veronica Tongio-Igot, ng RTC Branch 65, ang demurrer ton evidence na isinampa ng kampo ni Espinosa.
Sa 21-pahinang desisyon, binanggit na nabigo ang panig ng prosekusyon na magsumite ng sapat na ebidensiya para mapatunayan ang pagkakasala ni Espinosa.
Napawalang-sala din ang kapwa akusado sa kaso na si Marcelo Adorco.
Sa inihain niyang petisyon, sinabi ni Espinosa na hindi maaring tanggapin ang mga sinumpaang-salaysay ni Adorco base sa katuwiran na nabigo ang prosekusyon na makilala ang karapatan ng akusado.
Hindi rin maaring tanggapin ng korte ang mga naging testimoniya ni Espinosa nang humarap ito sa mga pagdinig sa Senado noong Nobyembre 23, 2016 at Disyembre 5 2016.
“The prosecution failed to prove the existence of the elements of conspiracy to commit illegal trading of dangerous drugs under Section 26 (b), in relation to Section 5 of R.A. 9165, as amended by R.A. 10640. In this case, the evidence of the prosecution failed to prove the elements of the offense to sustain a conviction beyond reasonable doubt,” ang bahagi ng desisyon ng korte.
