Anti-Smuggling Law pinahirap ng Customs Bureau – Pimentel
Hiniling ni Senate Minority Leader na mabusisi ng Committee on Justice ang implementing rules and regulations (IRR) ng Republic Act 10845 o ang Anti-Agricultural Smuggling Act of 2016.
Sa pagdinig ng komite sa panukala na pagbuo ng Anti-Smuggling Act, binanggit ni Pimentel na dapat alamin kung paano ang simpleng batas ay naging komplikado dahil sa IRR na binalangkas ng Bureau of Customs.
“Maybe we can add a specific crime to the law like ‘refusal to prosecute large scale agricultural smuggling’ which will make liable the legal department (of the Bureau of Customs) and even the Department of Justice prosecutors, depending on the evidence,” ani Pimentel.
Maihahalintulad aniya ito sa kasong obstruction of justice at ang kanyang hirit na rebyu ang sa kanyang palagay ang magsisilbing daan upang magkaroon ng ngipin ang batas.
Nais din ng senador na maamyendahan ang Section 3 ng RA 10845 upang maisama ang Department of Justice (DOJ) sa pagdetermina ng halaga ng nakukumpiskang ipinuslit na mga produkto.
