Kaso vs Purisima at Napeñas kaugnay sa Mamasapano incident, pinasasampa na ng Ombudsman

Iniutos na ng Office of the Ombudsman ang pagsasampa ng kasong graft at usurpation of authority laban kina dating PNP Chief Alan Purisima at dating PNP-SAF Chief Getulio Napeñas.

Pinagtibay ng Ombudsman ang pagsasampa ng nasabing mga kaso at ibinasura lamang ang apela na inihain ng dalawang dating mataas na opisyal ng PNP

Ayon kay Ombudsman Conchita Carpio-Morales, maliban sa nabanggit na mga kasong kriminal, guilty rin ang dalawa sa mga kasong adminsitratibo na grave misconduct, gross neglect of duty at conduct Prejudicial to the Best Interest of the Service matapos ang madugong kinahinatnan ng Mamasapano operation na ikinasawi ng 44 na tauhan ng SAF.

Sa desisyon, sinabi ng Ombudman, lumabag sa PNP chain of command si Purisima nang pangunahan nito ang Oplan Exodus kahit siya ay nakasailalim noon sa preventive suspension.

“Purisima’s active participation and supervision of Oplan Exodus despite the 10 December 2014 preventive suspension order of the Ombudsman and the 16 December 2014 cease and desist order of OIC-PNP Chief Espina both issued against him, violated the PNP chain of command and amounted to usurpation of official functions,” nakasaad sa desisyon ng Ombudsman.

Napatunayan ding liable at guilty si Napeñas dahil sa pagrereport nito noon kay Purisima ng mga update sa operasyon nang hindi nalalaman at walang approval mula sa noon ay OIC-PNP Chief Leonardo Espina.

“Insofar as Napeñas is concerned, “his constant reporting and official dealings with Purisima, notwithstanding the latter’s suspension, and sans the knowledge and approval of then-OIC PNP Chief Espina, made him liable as a cohort of Purisima in usurping official functions,” ayon pa sa Ombudsman.
