Kahit patay na, 20% senior citizen discount tuloy pa – SC

Sakop ng 20 percent discount ang serbisyo ng burol at paglilibing sa mga yumaong senior citizen, ayon sa Korte Suprema. Ito ang nakasaad sa desisyon na inilabas ng Supreme Court en banc kung saan pinapawalang-bisa ang dalawang resolusyon ng Cagayan de Oro City Regional Trial Court noong Enero at Oktubre  2018 na nagsasabing ang interment services ay hindi sakop ng diskuwento para sa mga senior citizen. Isinulat ni Associate Justice Rodil Zalameda ang desisyon. Nag-ugat ang kaso sa inihaing special civil action ng isang domestic corporation na nagbebenta ng memorial lots at nag-aalok ng interment services. Sa naging pasya noon ng RTC sinabing ang interment services o paglilibing ay walang 20% discount sa ilalim ng Republic Act 7432 o Senior Citizens Act na inamyendahan ng RA 9257 at RA 9994. Pero ayon sa Korte Suprema, walang eksaktong depinisyon na isinaad sa RA 9527 at RA 9994 hinggil sa “funeral” at “burial services.” Sinabi ng Korte Suprema na ang “burial service” ay nangangahulugan ng mga serbisyo na iniaalok kaugnay sa final disposition, entombment, o interment ng yumao. Malinaw ayon sa SC na sakop ng burial services ang interment services kabilang na ang paghuhukay ng lupang paglilibingan, pag-semento ng pintod, at iba pang serbisyo na ginagawa kapag inililibing ang isang yumao. “The Court found that the exclusion by the RTC of interment services from the coverage of the 20% senior citizen discount is not provided under the law, and the IRR, which does not explicitly exclude interment services, cannot be interpreted to support the lower court’s resolution,” ayon sa desisyon ng SC.
