Pag-absuwelto sa 4 na ex-DA officials sa ‘sugar mess’ binalewala ni Tolentino

Walang epekto sa naging rekomendasyon ng Senate Blue Ribbon Committee ang pag absuwelto ng Office of the President (OP) sa apat na dating opisyal ng Department of Agriculture (DA) na isinangkot sa kontrobersyal na Sugar Order No.4. Ito ang sinabi ni Sen. Francis Tolentino, ang namumuno sa komite na nag imbestiga sa naturang kautusan. “The clearance given by the OP Usec for Legal Affairs does not affect the 97-page Senate Blue Ribbon Committee Report which was adopted unanimously by the Upper Chamber, in aid of legislation, and following several full-blown  public hearings conducted,” ani Tolentino. Dagdag pa ng senador, ang internal motu propio administrative investigation report na ginawa ng Ehekutibo ay iba sa ulat ng Blue Ribbon Committee Report,” diin pa ng senador. Alinsunod na rin aniya ito sa ‘ rules of a co-equal branch of the Government.’ Binanggit pa nito ang  isang naging desisyon  ng Korte Suprema ang People v Paredes (2007), kung saan nakasaad ang; “The dismissal of an administrative case does not necessarily bar (prevent) the filing of a criminal prosecution for the same or similar acts which were the subject of the administrative complaint”. Paliwanag ni Tolentino, anumang ang maging kalabasan ng pagiimbestiga ng Ehekutibo, Lehislatura at Ombudsman ay walang kinalaman sa isat-isa at hindi makakaapekto sa pagsasampa ng anumang kasong kriminal alinsunod sa Article 89 ng Revised Penal Code, kasama na ang pagkakabasura sa kasong administratibo.
