Oral arguments sa SC sa pagpapaliban sa Barangay, SK elections itinakda
Alas-3 ng hapon bukas magsisimula ang mga argumento sa petisyon kaugnay sa posibleng paglabag sa batas ng Republic Act No. 11935 na nagpaliban sa Barangay at Sangguniang Kabataan elections.
Inatasan ng Korte Suprema ang Commission on Elections (Comelec) gayundin ang Office of the President sa pamamagitan ni Executive Sec. Lucas Bersamin na maghain ng kanilang komento sa petisyon hanggang alas-12 ng tanghali sa Biyernes.
Noong Lunes, inihain ni election lawyer Romulo Macalintal ang petisyon na nagsabing ang kapangyarihan na ipagpaliban ang eleksyon ay nasa Comelec lamang base sa Omnibus Election Code of the Phils.
Aniya ang tanging kapangyarihan ng Kongreso ay itakda ang termino ng mga opisyal ng barangay.
“The Constitution does not give Congress the power to postpone the barangay elections nor to extend the term of office of the barangay officials,” diin ni Macalintal.
Katuwiran pa nito, ang mga opisyal ng barangay ay inihalal at hindi itinalaga.
