Conflict of interest sa appointment ni Raphael Lotilla sa DOE, legalidad kinuwestiyon

Pinaniniwalaan na lulutang ang usapin ng ‘conflict of interest’ gayundin ang legalidad kapag pinamunuan ni Raphael Lotilla ang Department of Energy (DOE).

Kaugnay ito sa nakasaad sa Section 8 ng RA 7638, ang batas na lumikha sa Department of Energy, na nagbabawal sa sinoman na may koneksyon o interes sa private energy company sa nakalipas na dalawang taon na maitalaga para pamunuan ang kagawaran.

Nang ianunsiyo ng Malakanyang ang pagtatalaga ni Pangulong Marcos Jr., sa DOE, agad lumutang na nananatili siyang director ng Aboitiz Power, gayundin sa Enexor, isang kompaniya ng mga produkto para sa enerhiya.

“No officer, external auditor, accountant or legal counsel of any private company or enterprise primarily engaged in the energy industry shall be eligible for appointment as Secretary within two years from his retirement, resignation or separation therefrom,” ang nakasaad sa naturang batas.

Ngayon, pinag-aaralan na nina Justice Sec. Jesus Crispin Remulla at Solicitor General Menardo Guevarra ang pagtatalaga kay Lotilla base sa nakasaad sa nabanggit na batas, kasama na ang kanyang pagiging opisyal ng dalawang pribadong kompaniya.

Pinangangambahan na magamit si Lotilla ng mga nasa pribadong sektor na may interes sa enerhiya.

Nagsilbi ng DOE secretary si Lotilla noong 2005 – 2007 sa ilalim ng administrasyong- Arroyo.

Agad din naman nilinaw ng Malakanyang na nominado pa lamang si Lotilla na pamunuan muli ang kagawaran.
