Naghain ng kasong paglabag sa automated election system law sa Commission on Elections ang kampo ni Vice Presidential candidate Ferdinand Marcos Jr. laban sa mga executive ng Smartmatic at Comelec.
Ito ay dahil sa biglang pagbabago ng Smartmatic sa script ng transparency server na ginamit ng Comelec sa katatapos na May 9 national elections.
Partikular na kinasuhan ng paglabag sa Republc Act 8436 sina Marlon Garcia ang Venezuelan IT expert ng Smartmatic at sina Israeli Project Director na si Elie Moreno, Neil Banigued na miyembro ng Smartmatic Technical Support Team at Rouie Peñalba na nakatalaga sa Information Technology Department ng Commission on Elections.
Ayon kay Congressman Jonathan dela Cruz, na siyang campaign adviser ni Marcos at naging complaint sa kaso, dapat na ipa-subpoena ng Comelec ang apat na nabanggit na indibidwal para pagpaliwanagin sa naturang isyu.
Iginigiit ng kampo ni Marcos na labag sa automated election sytem law ang ginawa ng apat dahil sa pakikialam ng mga ito sa transparency server dahilan para pagdudahan ng publiko ang kredibilidad ng resulta ng katatapos na halalan.
Kwestyunable aniya ang pagkakaroon ng access ng apat para mapalitan o sirain ang computer data, program at system software, network o alinmang computer-related devices, facilities, hardware o equipment.
Giit ni Dela Cruz, nakakapagduda ang insidente dahil sampung minutong tumigil ang transmission ng election results noong gabi ng May 9 mula sa iba’t ibang presinto sa buong bansa matapos palitan ang command sa transparency server.
