Paglalabas ng SC ng TRO vs Oplan Baklas, nirerespeto ng DILG
Nirerespeto ng Department of the Interior and Local Government (DILG) ang paglabas ng Temporary Restraining Order (TRO) ng Supreme Court laban sa “Oplan Baklas” ng Commission on Elections’ (Comelec).
Kampanya ito ng poll body para tanggalin ang mga campaign poster na oversized o nakalagay sa mga ipinagbabawal na lugar.
Sa en banc resolution, ipinag-utos ng Mataas na Hukuman sa Comelec at sa tagapagsalita nito na si James Jimenez na magkomento sa petisyon sa susunod na 10 araw simula nang matanggap ang notice.
“The petitioners sought the issuance of a TRO, while the resolution of the petition is pending, prohibiting the Respondents from implementing Section 21 (o), Section 24, and Section 26 of COMELEC Resolution No. 10730 with respect to the poll body’s order to dismantle, remove, destroy, deface, and/or confiscate all election materials that are privately owned and privately funded solely by volunteers and private citizens and posted and/or installed within their private properties,” saad sa resolusyon ng SC.
Sinabi naman ni DILG Undersecretary at Spokesperson Jonathan Malaya na aabisuhan nila ang lahat ng lokal na pamahalaan, ang Philippine National Police (PNP), at iba lang law enforcement agency na suspindehin ang mga nakaplano at isinasagawang Oplan Baklas activities sa buong bansa.
“Our police officers and barangay officials are merely following the lawful orders of the COMELEC, but in this case where the Supreme Court itself has issued an order on the matter, we are bound to comply,” pahayag nito.
Ani Malaya, tanging ang Sections 21, 24, at 26 lamang ang nabanggit sa TRO.
Dahil dito, epektibo pa rin ang iba pang probisyon ng Comelec Resolution No. 10730.
“With respect to the other provisions not subject of the TRO, we will continue to implement those as may be directed by the Comelec,” saad ni Malaya.
