Hiniling ng Office of the Solicitor General (OSG) sa Korte Suprema na resolbahin na ang kasong kinasasangkutan ng kumpanyang Now Telecom hinggil sa P2.6 billion na halaga ng hindi nabayarang utang sa gobyerno.
Naghain ng mosyon ang OSG sa SC upang ma-recover na ng pamahalaan ang hindi nabayarang Supervision and Regulation Fee (SRF) at Spectrum User Fees (SUFs) kabilang ang accumulated fines at penalties na nabigong bayaran ng Now Telecom.
Ayon sa OSG, ang nasabing halaga ay malaking bagay para magamit sa COVID-19 response ng pamahalaan.
Sa inihaing motion for early resolution, hiniling ng OSG sa SC na resolbahin na sa lalong madaling panahon ang kaso dahil ang bawat partidong sangkot ay nakapagsumite naman na ng kanilang memoranda.
“Considering the contingent nature of the collection of the aforementioned receivables, and in further consideration of the government’s needs for funds to defray the costs of its COVID-19 response, the prompt resolution to the present cases is most humbly requested,” ayon sa mosyon ng OSG.
Ang P2.6-B sinisingil ng gobyerno sa Now Telecom, na 85.32% ng mahigit sa P3 bilyon na “unresolved receivables” ng gobyerno, ay bahagi ng report ng state auditors mula Enero 1 hanggang Disyembre 31, 2020.
“Particularly for the present cases, the Commission on Audit took note that unresolved receivables in the total amount of Php2,615,868,531.30 is attributed to the above-captioned cases in the form of unpaid Supervision and Regulation Fees (SRF) and Spectrum User Fees (SUF), including accumulated fines and penalties, computed as of 31 December 2020,” dagdag pa ng OSG.
Ang reiterative motion ay una nang naihain ng OSG para sa maagang resolusyon sa Korte Suprema noong Pebrero 2019.
Kinuwestyon ng Next Mobile, Inc, dating pangalan ng Now Telecom Company, Inc., ang desisyon at resolusyon ng Court of Appeals noong 2009, na nagpapatibay sa letter-assessment ng telecommunications regulatory body na naghahangad na mabawi na ang P126 milyon na SRF at halos P9.7 milyon sa SUF, noong Disyembre 2005.
Noong Disyembre 2020, umabot na ang unpaid obligation ng Now Telecom sa gobyerno sa P2,615,868,531.50, kasama na ang penalties at fines.
