Surigao Del Sur Rep. Prospero Pichay, Jr. pinadi-disqualify

Naghain ng petisyon sa Commission on Election (Comelec) si Construction Worker’s Solidarity (CWS) party-list Representative Romeo Momo para ipa-disqualify si Surigao Del Sur 1st District Rep. Prospero Pichay, Jr.

Ayon kay Momo, ito ay dahil sa wala nang karapatan si Pichay na humawak ng public office dahil nahatulan na ng guilty ng Court of Appeals dahil sa grave misconduct.

Kaakibat aniya sa hatol ng CA na dismissal sa government service at perpetual disqualification to hold any public office.

Pinakakansela ni Momo sa Comelec ang certificate of candidacy ni Pichay dahil sa naturang desisyon ng CA.

Nagsinungaling din aniya si Pichay nang sumagot ng ‘no’ sa tanong ng Comelec kung naging liable na ito sa isang offense na may kasamang accessory penalty of perpetual disqualification to hold public office.

“Fully aware of the concurrence of respondent Pichay, Jr.’s false representation pertaining to a material matter which refers to his qualifications for elective office, of his deliberate attempt to mislead, misinform, or hide a fact which would otherwise render him eligible and of his intention to deceive the electorate as to his qualifications for public office,” pahayag ni Momo.

Base sa records ng Ombudsman, ibinasura nito ang motion for reconsideration ni Pichay para baliktatin ang hatol.

“That subsequently, the Honorable Commission issued COMELEC Document No. 17-0108 (LAW 16-04243) confirming that in its 09 December 2015 letter to Atty. Wendell Ian C. Perez, Graft Investigation and Prosecution Officer II, that the name of respondent Pichay, Jr. , among others, was entered in the database/list of those who are perpetually disqualified to hold public office/reemployment in the government service for purposes of subsequent elections,” pahayag ni Momo.

Matatandaang naging chairman ng Local Water Utilities Administration si Pichay.

Nahataulang guilty si Pichay sa pag-iinvest ng P780 milyong LWUA funds para bumili ng 60-percent share ng local thrift bank na Express Savings Bank Inc. noong 2009.

Itinuloy pa rin ni Pichay ang hakbang kahit na hindi inaprubahan ng Department of Finance (DOF) at Office of the Solicitor General (OSG).
