Leopard gecko, nasamsam ng BOC

Nasamsam ng Bureau of Customs- NAIA (BOC-NAIA), katuwang ang Department of Environment and Natural Resources (DENR), ang isang buhay na leopard gecko noong July 5, 2021.

Natagpuan ang leopard gecko sa isang parcel na nagmula sa Thailand at dumating sa Paircargo warehouse nang walang kalakip na import permit mula sa DENR.

Bunsod nito, nagsagawa ng 100 porsyentong physical examination at saka nasabat ang leopard gecko na tinatayang nagkakahalaga ng P20,000.

Ayon sa DENR, ang gecko ay isang species ng hayop na kinokontrol sa ilalim ng Convention on International Trade in Endangered Species of Wild Flora and Fauna (CITES) at protektado sa bisa ng Republic Act (RA) No. 9147 o Philippine Wildlife Resources Conservation and Protection Act.

Ang pagngongolekto at pangangalakal nito ay kinakailangang ng import permit mula sa Biodiversity Management Bureau sa ilalim ng DENR.

Sinumang mapatunayang lumabag sa Republic Act 9147 ay makukulong ng hindi bababa sa apat na taon at multang P300,000.

Dadaan ang nakuhang leopard gecko sa seizure at forfeiture proceedings dahil sa paglabag sa Section 1113 na may kinalaman sa Section 117 ng Republic Act 10863 o Customs Modernization and Tariff Act (CMTA) and Section 11 of RA 9147.

Magsasagawa ang DENR ng case building at prosecution laban sa importer at co-conspirators sa paglabag sa Republic Act 9147.

Kikilos din ang Bureau Action Team Against Smugglers (BATAS), Legal Service ng Bureau of Customs, para sa gagawing case build-up at prosecution bunsod ng paglabag sa Section 1401 ng CMTA.
