Tower buildup ng DITO-China Telecom, sinalubong ng sunud-sunod na reklamo

Nahaharap sa panibagong reklamo ang DITO Telecommunity Corporation, ang third telco ng bansa, kaugnay sa umano’y ilegal na pagtatayo ng cell tower.

Ang commercial rollout ng DITO ay nakatakda sa darating na Marso kung saan nangako ang kompanya na magkakaloob ng
serbisyo sa 37 porsiyento ng populasyon ng bansa na may 27 megabits per second (mbps).

Nanindigan sa mga karapatan ng indigenous peoples (IPs) sa free and prior informed consent (FPIC), na itinatakda sa ilalim ng Section 59 ng Republic Act 8371 o ang “Indigenous Peoples Rights Act (IPRA),” nagpalabas ang National Commission on Indigenous Peoples-Cordillera Administrative Region (NCIP-CAR) ng show-cause order sa DITO Telecommunity dahil sa umano’y paglabag sa mga karapatan ng IP sa ancestral domains (ADs) ng Benguet province.

“It has come to our attention that your company has undertaken or is currently undertaking fiber-optics laying in the various ADs in Benguet province without securing the FPIC [from] concerned indigenous cultural communities/indigenous peoples (ICCs/IPs) and paying just and fair compensation for damages [that] they may sustain as consequence thereof,” nakasaad sa show-cause order ng NCIP-CAR sa DITO mula kay Regional Director Marlon Bosantog.

Bukod sa FPIC, ipinaliwanag ng komisyon sa DITO na, “Section 7 (b) of the IPRA [also] recognizes, protects and promotes, among others, the rights of the ICCs/IPs to an informed and intelligent participation in the formulation and implementation of any project, government or private, that will affect or impact upon the ancestral domains and to receive just and fair compensation for any damages [that] they may sustain as a result of the project.”

Ang DITO ay binigyan ng 15 araw para tumugon at magprisinta ng mga kadahilanan kung bakit hindi sila dapat papanagutin sa paglabag sa IPRA.

Ang kompanya ay may nakabimbing aplikasyon sa NCIP-CAR para sa konstruksiyon ng telecommunication tower sa La Trinidad, Benguet.

Sa kabila ng umiiral na aplikasyon, ang proyekto ay nasa preliminary stages pa rin ng FPIC process.

Kamakailan lamang ay kinasuhan ang DITO ng pamahalaang lokal ng Malabon ng paglabag sa Section 301 ng Presidential Decree 1096 o ang National Building Code of the Philippines sa Malabon City Prosecutor’s Office dahil sa umano’y ilegal na pagtatayo ng cell site sa lungsod.

Ayon kay City Engineer Christian Uriarte ng Malabon City Engineering Office, ang DITO ay tatlong beses nilang pinadalhan ng violation notice na binalewala lamang ng kompanya.

May isyu rin ang LGU authorities sa lalawigan ng Cebu laban sa road engineering works na isinasagawa sa main thoroughfares sa isang commercial district.

Ipinatawag ni Cebu Governor Gwen Garcia ang mga opisyal ng DITO Telecommunity noong nakaraang buwan makaraang magdulot ng matinding trapik ang paghuhukay ng telco sa bayan ng Consolacion.
