Petisyon para ihinto ng LTFRB ang pagpapatupad ng limited public transportation sa NCR, ibinasura ng korte
Ibinasura ng Quezon City Regional Trial Court Branch 219 ang petition for injunction na inihain ni Atty. Ariel Inton ng Lawyers for Commuters Safety and Protection para ipahinto ang Memorandum Circular ng Land Transportation Franchising and Regulatory Board para sa limited public transportation in Metro Manila habang nasa ilalim ng general community quarantine (GCQ).
Base sa 17-pahinang desisyon ni Judge Janet Abergos-Samar, ibinasura nito ang petisyon ni Inton dahil hindi ito real party of interest bukod pa sa hindi nito inilagay ang kanyang cause of action.
Sabi ng korte, walang sinabi ang petitioner na mayroon itong hinahawakang CPC para sa mga bus na nag-ooperate sa Metro Manila na apektado sa pagpapatupad ng kautusan ng regulatory body.
“Petitioner did not allege that he is a holder or franchisee of certificate of public convenience for a public utility bus/es whose route/s will be allegedly modified/amended by MC No. 2020-019. Not having been granted a certificate of public convenience for a public utility bus, it cannot be said that his right under the public franchise was violated by respondent (LTFRB) in the implementation of MC No. 2020-019. Obviously, the 3 essential elements of a cause of action are not present,” saad ng korte.
Sa kanyang judicial affidavit, nilinaw ni Inton na inihain niya ang petisyon sa kanyang personal na kapasidad at hindi bilang bahagi o kumakatawan sa Lawyers for Commuters’ Safety and Protection.
Hindi rin tinanggap ng korte ang alegasyon ng petitioner na hindi nailathala ang kautusan dahil walang nakalagay sa effectivity clause nito na publication.
Sa pasya ng husgado, sinabi nito na nailathala ito sa isang broadsheet bukod pa sa nagpadala ang LTFRB ng notices sa mga kinakauukulan.
Sa petisyon ni Inton, kinuwestyon nito ang bisa ng MC 2020-019 ng LTFRB kung saan sakop ang existing na certificates of public convenience ng mga public utility buses na may operasyon sa National Capital Region at bumuo ng 31 “rationalized bus routes.”
