Sen. De Lima may hirit sa pagbasura ng korte na makasali siya sa special sessions

Naghain ng mosyon si Senator Leila de Lima para mairekonsidera ang pagbasura ng korte sa kanyang omnibus motion na makasali sa Senate session sa pamamagitan ng teleconferencing habang siya ay nakakulong sa PNP Custodial Center.

Sa kanyang pitong pahinang motion for reconsideration na may petsang Hunyo 22, hiniling nito kay Judge Liezel Aquitan ng RTC Branch 205, na irekonsidera ang nauna nitong pagbasura sa kanyang mosyon noong Hunyo 17.

Ayon sa senadora hindi niya maintindihan ang naging konklusyon ni Aquitan na ‘walang pagkakaiba sa pisikal na pagdalo sa Senate session ang nais niyang makasama sa teleconferencing ng mga senador.’

“With all due respect, the Honorable Court’s reasoning is neither here nor there in terms of applying the Supreme Court ruling in Trillanes and Jalojos that legislators under detention are expected to have legislative output and perform the functions of their office within the physical limitation imposed upon them by the conditions of their detention,” diin ni de Lima.

Sabi pa nito, “substantially, the last word of the Supreme Court on the matter is that so long as the detained legislator is able to perform legislative functions within his or her place of detention, there is nothing in the law that prevents him or her from doing so.”

Binanggit din nito ang bagong Senate rule na nagbibigay sa kanya ng oportunidad na gampanan ang kanyang tungkulin bilang mambabatas kahit sa loob ng kulungan.
