POGO iginiit na dapat magbayad ng 5-percent franchise tax sa gobyerno
Iginiit ni House Committee on Dangerous Drugs Chair at Surigao del Norte Rep. Robert Ace Barbers na hindi exempted sa pagbabayad ng limang porsyentong franchise tax ang mga Philippine Offshore Gaming Operators o POGO.
Ayon kay Barbers, mayroong 60 PAGCOR-licenced POGOs sa bansa pero 10 lamang sa mga ito ang nakarehistro sa Securities and Exchange Commission at mayroong presensya sa bansa.
“All these Pagcor-licensed POGOs, including the 10 that are registered with the SEC, are either domestic or foreign corporation registered to do business in the Philippines,” ani Barbers.
Dahil dito, wala aniyang kuwestyon at malinaw na dapat lamang ang mga itong patawan ng 5-percent franchise tax.
May kaugnayan naman sa mga POGO na hindi rehistrado sa SEC pero may operasyon sa Pilipinas marapat din aniya ang mga itong magbayad ng nasabing buwis.
“These non-SEC registered POGOs cannot deny the fact that they have brought in their equipment, rented or bought office facilities, and have employees working in the Philippines. Thus, they cannot claim they have no physical presence here,” giit pa ni Barbers.
Sa ilalim ng Presidential Decree No. 1869 o ang PAGCOR charter, lahat ng binigyan ng mga ito ng lisensya upang makapag-operate ay dapat na magbayad ng 5-percent franchise tax.
Paliwag nito sa pag-interpret ng batas sa pagbubuwis ang sinusunod ay pabor ito sa estado na nagpapataw ng tax.
Kaugnay nito, iginiit ng mambabatas na walang legal na balakid para sa Bureau of Internal Revenue (BIR) upang magpataw at maningil ng franchise tax sa lahat ng POGO.
Nauna na nang iniulat ng BIR na nasa P50 bilyong buwis ang hindi binayaran ng POGO noong 2019 sa bansa.
