Constitutionality ng EDCA, pinababaligtad sa Korte Suprema

Hiniling nina dating Senador Rene Saguisag, Wigberto Tañada at ng grupong Bagong Alyansang Makabayan sa Korte Suprema na irekonsidera ang desisyon nitong nagdedeklara bilang ‘constitutional’ ang Enhanced Defense Cooperation Agreement o EDCA.

Ang dalawang dating mambabatas ay kabilang sa 12 senador na bumoto para maalis ang mga base militar ng Amerika sa bansa noong 1991.

Sa kanilang hiwalay na motion for reconsideration, kapwa iginiit ng tatlo na dapat ay ang sambayanan at ang Senado ang nagdesisyon kung nais nitong payagan ang muling pagkakaroon ng US military presence sa bansa.

Hindi ito anila dapat pinagdesisyunan lamang ng korte at ng Executive Department.

Matatandaang sa kanilang January 12 ruling, sinabi ng Kataas-taasang Hukuman na ang EDCA ay isang executive agreement na pwedeng pasukin ng Pangulo ng bansa sa ilalim ng Article XVII Section 25 ng 1987 Constitution.
