NTC iginiit ang kanilang desisyon sa Newsnet-GHT ‘unutilized’ frequency sharing

Muling ipinaalala ng National Telecommunications Commission (NTC) ang kanilang desisyon na nag-aatas sa
News and Entertainment Network Corp. (Newsnet) na gamitin ang unutilized frequencies na naka-assign sa kanilang sister company na GHT Network, Inc. (GHT).

Ang naturang kautusan na inilbas noong nakaraang January 27, 2020 na nagbibigay sa Newsnet ng Provisional Authority (PA) na gamitin ang frequencies, 26.35-27.35 GHz.

Nakasaad sa bahagi ng desisyon ng NTC, “a review of GHT’s operationsin terms of radio station license or permit and as a consequence, has not utilized the frequencies assigned to it in accordance with its PA for over a year sinceits grant.”

Ang Newsnet at GHT ay affiliated din o kasapi ng Now Corp. at Now Telecom Corp.

Matatandaan na noong Feb. 12, naglabas ang Anti-Red Tape Authority’s (ARTA) ng hiwalay na kautusan sa
NTC na agad ipalabas ang certificate of public convenience ng Newsnet at magsumite ng compliance report sa loob ng tatlong araw matapos nilang matanggap ang kautusan.

Sa kanilang panig, ay agad na tumalima ang NTC sa notice ng ARTA na nakasaad na ipinagkaloob na nito sa Newsnet ang PA sinula pa noong January 27, at naglakip din ito ng clarification o paglilinaw na walang hurisdiksiyon ang ARTA sa quasi-judicial functions ng NTC.

“Radio frequency assignment, subject to treaty obligations, is also exempt from ARTA’s coverage,” paglilinaw pa ng NTC.

Ayon kay Deputy Commissioner Edgardo Cabarios, hihintayin ng NTC ang desisyon ng Department of Justice para resolbahin ang usapin may kaugnayan sa Presidential Decree 242 at ng Revised Administrative Code may kinalaman sa mga ahensiya ng gobyerno.
