Kaso laban kay dating Palawan Gov. Mario Joel Reyes muling lilitisin; CA iniutos ang paglalabas ng warrant of arrest laban sa dating gobernador
Iniutos ng Court of Appeals (CA) na muling magsagawa ng proceedings sa kasong kriminal laban kay dating Palawan governor Mario Joel Reyes kaugnay sa pagkamatay ng environmentalist na si Dr. Gerardo “Gerry” Ortega noong 2011.
Sa labingisang pahinang amended decision ng CA Special Former Eleventh Division, pinabigyan nito ang motion for reconsideration na inihain ng Office of the Solicitor General.
Binaligtad ng CA ang nauna nitong desisyon noong January 2018 at iniutos ang pag-reinstate sa original information ng kaso at inatasan din ang Palawan Regional Trial Court (RTC) na mag-isyu ng warrant of arrest laban kay Reyes.
Sa inilabas na desisyon, inamin ng CA ang pagkakamali sa orihinal nitong pasya.
“Indeed, the assailed decision has set the parameters of probable cause too high. The defenses raised by petitioner (Reyes), particularly the inadmissibility of (witness Rodolfo) Edrad extrajudicial confession and the alleged inconsistencies in the statements of the prosecution witnesses, are matters which are evidentiary in nature and best threshed out in a full-blown trial,” ayon sa CA.
Ayon sa CA, ang tamang aksyon sa kaso ay hindi ang ibasura ito kundi ang isailalim ito sa paglilitis.
Ayon pa sa Cam walang grave abuse of discretion sa panig ng Palawan RTC Branch 52 ng magpalabas ito ng omnibus order noong March 27, 2012 na nagbabasura sa motion to suspend proceedings ni Reyes.
