ICC ibinasura ang reklamo nina Morales, Del Rosario vs Xi Jinping
Ibinasura ng Office of the Prosecutor ng International Criminal Court (ICC) ang inihaing reklamo nina dating Ombudsman Conchita Carpio-Morales at dating Foreign Affairs Secretary Albert del Rosario laban sa China at sa pangulo nitong si Xi Jinping.
Magugunitang noong March 2019, nagsampa ang dalawa ng kasong ‘crimes against humanity’ laban kay Xi dahil sa hindi makataong mga hakbang sa West Philippine Sea.
Sa kanilang reklamo, sinabi nina Morales at del Rosario na libu-libong mangingisda ang naaabuso at naaapektuhan ng agresibong pag-okupa ng China sa mga isla sa WPS.
Pero ayon sa ulat ng ICC prosecutor na inilabas araw ng Huwebes, hindi nila maaaksyunan ang reklamo dahil hindi bahagi ang China ng Rome Statute – ang kasunduang bumuo sa ICC.
“The crimes referred to in the communication were allegedly committed by Chinese nationals in the territory of the Philippines. China is not a State Party to the Rome Statute. Accordingly, the Court lacks personal jurisdiction,” ayon sa ICC.
Iginiit pa ng ICC na hindi maaaksyunan ang sinasabing krimen dahil naganap ito hindi sa mismong teritoryo ng Pilipinas kundi sa exclusive economic zone (EEZ) lamang.
“The information available confirms that the alleged conduct in question occurred in areas that are outside of the Philippines’ territorial sea (i.e., in areas farther than 12 nautical miles from its coast), but nonetheless within areas that may be considered to fall within its declared EEZ,” ayon sa ICC.
“In this context, the Office’s analysis has been conducted ad arguendo without taking a position on the different disputed claims with respect to these areas. However, the Office has concluded that a State’s EEZ (and continental shelf) cannot be considered to comprise part of its ‘territory’ for the purpose of article 12(2)(a) of the Statute,” paliwanag pa ng international court.
Sa pahayag naman araw ng Huwebes, sinabi nina Morales at del Rosario na hindi ibinasura ng ICC ang kanilang reklamo.
Nagbibigay anya sila ng bagong mga ebidensya sa prosecutor para maipagpatuloy ang kaso
“The Prosecutor welcomes ‘new facts and evidence’ to proceed with the case and we are providing them. This has only strengthened our resolve,” ayon sa dalawang dating opisyal.
