DOJ: Vape na may tobacco derivatives, pwedeng basehan ng pag-aresto
Maaaring maaresto ang vapers na gumagamit ng vape juice na may tobacco derivatives ayon kay Justice Secretary Menardo Guevarra.
Ito ay sa gitna ng pagkwestyon sa ginagawang paghuli sa vapers dahil wala pang written order para rito.
Sa panayam ng media araw ng Huwebes, sinabi ni Guevarra na maaaring gamitin ang umiiral na Executive Order No. 26.
Sa ilalim ng naturang EO, ipinagbabawal ang paninigarilyo sa pampublikong lugar sa buong bansa maliban sa designated smoking areas (DSAs).
Ang naturang EO ay nilagdaan ni Pangulong Rodrigo Duterte noong 2017 kung saan nakasaad ang pagbabawal sa tobacco products.
“The existing EO prohibiting smoking in public places may apply to vaping only insofar as such vaping makes use of any tobacco derivative and produces smoke in the process,” ani Guevarra.
Sinabi naman ni Guevarra na nagpasabi ang Office of the President (OP) na ilalabas ang isang bagong EO na sasaklaw sa lahat ng uri ng vaping.
Hindi naman malinaw kung aarestuhin ang vapers sa DSAs.
“In my opinion and by analogy, there is no infraction under the existing EO (Executive Order) if the vaping is done in DSAs,” ani Guevarra.
Giit pa ng kalihim, wala siyang kapangyarihan na pigilan ang Philippine National Police (PNP) sa paghuli sa vapers.
Samantala, sinabi ni Integrated Bar of the Philippines (IBP) national president Domingo Egon Cayosa na maaaring kwestyunin sa korte ng sinuman ang verbal order ng pangulo para sa pag-ban sa vaping.
“I’m sure the President as a lawyer knows that. The fact that he has articulated his position does not hinder our courts from performing their constitutional duties,” ani Cayosa.
May kapangyarihan anya ang korte na dinggin ang mga petisyon na kumekwestyon sa ligalidad ng verbal order ni Duterte.
“At the end of the day, any citizen who feels aggrieved by the order can actually go to the court to challenge the order,” dagdag nito.
