Siyam na tinaguriang “Euro Generals” pinawalang sala ng Sandiganbayan
Pinawalang sala ng Sandiganbayan ang mga tinaguriang “Euro Generals” sa kasong graft at technical malversation kaugnay ng kontrobersiyal na pagdalo sa 2008 Interpol Conference sa Russia.
Ayon sa Sandiganbayan second division, walang sapat na basehan ang kaso laban sa siyam na pulis kabilang sina dating PNP comptroller Eliseo dela Paz.
Inaakusahan ang mga pulis na ginamit ang P10 million intelligence fund ng PNP bilang contingency fund at travel allowance nila para sa conference.
Sa 55 pahinang desisyon ng anti-graft court ang ebidensya ng prosekusyon kabilang ang circulars ng Commission on Audit (COA) na nagdedetalye sa kung paanong dapat ginagamit ang intelligence fund ay hindi nakapagpatunay na ginamit ng mali nina Dela Paz, Jaime Garcia Caringal, Ismael Rafanan, Orlando Pestaño, Samuel Rodriguez, Tomas Rentoy, Romeo Ricardo, German Doria at Emmanuel Carta, ang intel fund para sa Russia trip.
Ang naturang halaga ng salapi ay nakita sa pag-iingat ni Dela Paz at mga kasamang pulis nang sila ay pauwi sa Pilipinas mula sa conference.
“Technical malversation happens when the one who uses the funds under his administration for public use other than what it was appropriated for. These pieces of evidence [from COA] do not prove that the use of CIF (confidential and intelligence funds) for the expenses incurred by the PNP in its participation to the Interpol Assembly is not a covered expense,” ayon sa desisyon.
Kasabay nito ay binawi na rin ng Sandiganbayan ang Hold Departure Order laban sa mga akusadong pulis at iniutos ang pagre-release ng kanilang bail bonds.
