Bersamin nais mabalam ang botohan sa poll protest ni BBM

Umamin si Chief Justice Lucas Bersamin na nais niya sanang maantala ang botohan sa electoral protest ni dating Sen. Bongbong Marcos Jr. laban kay Vice President Leni Robredo.

Sa panayam ng media araw ng Miyerkules, sinabi ng punong mahistrado na nais niyang mabalam ang botohan dahil ayaw niyang maging bahagi nito.

Ito ay upang maiwasan ang ispekulasyon na niluto niya ang resulta.

“I wanted to delay the vote because I did not like to take part in it, because I did not like the public, like the media, speculating that I cooked or orchestrated the result. But I always told you: Hindi pwedeng magluto dito sa Supreme Court dahil ang daming involved,” ani Bersamin.

Pero nanaig anya ang en banc noong Martes at napagdesisyunang hingian ng komento sina Robredo at Marcos sa report ni Justice Alfredo Benjamin Caguioa.

Ang naging botohan ay 11-2 pabor sa paglalabas ng kopya ng inisyal na resulta at paghingi ng komento sa dalawang partido.

Paliwanag ni Bersamin, ang desisyon ng PET ay bahagi ng due process at kinakailangan lamang muna nilang makuha ang komento ng mga partido bago gumawa ng resolusyon.

“It was clear that, the majority, clear majority of the court wanted the action to be taken on the report. And before we could take any action, we had solicit the comments of the parties. That’s only fair, part of due process yan,” paliwanag ng CJ.

Bukod sa komento sa initial results, pinaghahain din sina Robredo at Marcos ng memoranda ukol sa third cause of action ni Marcos na nais ipabasura ang election results sa Maguindanao, Lanao del Sur at Basilan.

Samantala, nag-dissent sina Senior Associate Justice Antonio Carpio at Associate Justice Alfredo Benjamin Caguioa.

Ayon sa mga ulat, nais ng dalawang mahistrado na ma-dismiss na ang electoral protest dahil walang naging substantial recovery sa hanay ni Marcos matapos ang initial result.
