Carpio: PH-China verbal deal sa pangingisda sa WPS, labag sa Konstitusyon

Labag at taliwas umano sa Konstitusyon ang verbal agreement sa pagitan ng Pilipinas at China ukol sa pangingisda ng mga Chinese sa West Philippine Sea.

Pahayag ito ni Senior Associate Justice Antonio Carpio matapos sabihin ni Presidential Spokesman Salvador Panelo na verbal o sa usapan lamang ang kasunduan nina Pangulong Rodrigo Duterte at Chinese President Xi Jinping.

Kinumpirma ni Panelo na walang pinirmahang kasulatan ukol sa naturang kasunduan.

“This verbal agreement, aside from being clearly against the Constitution, is so lopsided it should be rejected by the Philippine government,” ani Carpio.

Sinuportahan naman ni Carpio si Foreign Affairs Secretary Teodoro Locsin Jr. sa pahayag nito na hindi pwedeng ipatupad ang verbal deal dahil kailangan na mayroong dokumento na magpapatunay sa kasunduan.

“DFA Secretary is correct that there is no official policy allowing the Chinese to fish in Reed Bank. Secretary Locsin knows that there is no recorded minutes of the so-called verbal agreement between President Xi and President Duterte allowing the Chinese to fish in Reed Bank in exchange for Filipinos fishing in Scarborough Shoal,” dagdag ng Mahistrado.

Sinabi pa ni Carpio na mabilis na mauubos ng mga Chinese ang mga isda sa Reed Bank dahil mayroon silang malalaking barkong pangisda kumpara sa de-kahoy na bangka ng mga mangingisdang Pilipino.

Iginiit pa ni Carpio ang probisyon sa Konstitusyon kaugnay ng exclusive economic zone (EEZ) ng bansa.

Sakop anya ng EEZ ng Pilipinas ang Reed Bank at sa ilalim ng Saligang Batas, ang paggamit at pagkuha ng likas na yaman na nasa loob ng EEZ ay nakareserba lamang para sa mga Pilipino.
