DOJ: Mga maghahain ng impeachment case vs Duterte hindi pwedeng arestuhin
Hindi maaaring arestuhin ang mga maghahain ng impeachment complaint laban kay Pangulong Rodrigo Duterte ayon mismo kay Justice Secretary Menardo Guevarra.
Sa pulong balitaan sa DOJ araw ng Martes, sinabi ni Guevarra na hindi naman labag sa batas ang paghahain ng impeachment.
“The question before us now is: Is filing a complaint for impeachment an unlawful act? And my answer to that question is, certainly no,” ani Guevarra.
Reaksyon ito ng kalihim matapos sabihin ni Philippine National Police (PNP) chief General Oscar Albayalde na aarestuhin nila ang impeachment case filers sakaling ipag-utos ng pangulo.
Nanindigan si Guevarra na laging susundin ng DOJ ang batas.
Ang pag-aresto anya ay ginagawa lamang kapag ang isang tao ay nahuling gumagawa ng krimen.
Dahil dito, wala anyang ligal na basehan sa pag-aresto sa mga sitwasyong wala namang batas na nalalabag.
“Unless somebody is caught in the act of committing a crime, you know, generally a warrant of arrest will be needed so there are only a few situations where warrantless arrests are allowed or permitted under our rules. So in situations where an unlawful act is not being committed in the first place, there will be no legal basis for an arrest,” ani Guevarra.
Una rito, sinabi ni Pangulong Rodrigo Duterte na ipaaresto niya ang mga maghahain ng impeachment complaint laban sa kanya dahil sa pagpayag na makapangisda ang mga Chinese sa West Philippine Sea.
Sinabi ni Senior Associate Justice Antonio Caripo na ang pagpayag na makapangisda ang China sa mga katubigan ng Pilipinas ay paglabag sa Konstitusyon.
