Carpio: Pagpayag sa mga Chinese na mangisda sa EEZ labag sa Konstitusyon
Iginiit ni Senior Associate Justice Antonio Carpio na ang pagpayag ng gobyerno na mangisda ang mga Chinese sa exclusive economic zone (EEZ) ng Pilipinas ay isang paglabag sa Konstitusyon.
Ito ay matapos sabihin ni Pangulong Rodrigo Duterte na hindi mapipigilan ang Chinese fishermen na makapangisda sa EEZ dahil kaibigan ng Pilipinas ang China.
Sinegundahan naman ito ni Presidential Spokesperson Salvador Panelo at sinabing kukunsintihin muna ng Pilipinas ang pangingisda ng China sa EEZ sa ngalan ng pagkakaibigan.
Pero hindi sang-ayon dito sa Carpio at binanggit ang nakasaad sa Saligang Batas na dapat pangalagaan ng Estado ang marine wealth sa loob ng exclusive economic zone nito at dapat magamit lamang mismo ng mga Filipino.
“The State shall protect the nation’s marine wealth in its xxx exclusive economic zone, and reserve its use and enjoyment exclusively to Filipino citizens,” bahagi ng 1987 Constitution na iginiit ni Carpio.
Ayon sa mahistrado, ang presidente bilang commander-in-chief ay may constitutional duty na utusan ang Sandatahang Lakas na protektahan ang yamang dagat ng bansa sa EEZ.
Sinabi ni Carpio na sa ilalim ng Konstitusyon kasama sa ‘national territory’ ang ibang ‘submarine areas’ na nakapaloob sa hurisdiksyon ng Pilipinas.
Iginiit pa ni Carpio na sa Hague ruling noong 2016 na pinal nang pinagtibay ang karapatan ng Pilpinas sa EEZ nito sa West Philippine Sea kabilang ang Recto Bank.
“The Philippines has exclusive sovereign right to exploit all the fish, oil, gas and other mineral resources in its Exclusive Economic Zone. This sovereign right belongs to the Filipino people, and no government official can waive this sovereign right of the Filipino people without their consent,” ani Carpio.
