Palasyo: ICC nakikialam sa soberenya ng Pilipinas dahil sa aksyon sa reklamo vs Duterte

Iginiit ng Malakanyang na talagang desidido ang International Criminal Court (ICC) na makialam sa soberenya ng Pilipinas dahil sa patuloy na hakbang laban kay Pangulong Rodrigo Duterte.

Pahayag ito ni Presidential Spokesman Salvador Panelo matapos sabihan ng ICC ang National Union of People’s Lawyers (NUPL) na agaran na nilang sinusuri ang reklamo ng grupo laban sa Pangulo.

“With the ICC writing the National Union of Peoples’ Lawyers a letter on April 4, 2019 saying that it will analyze the latter’s communication in the context of a situation already under preliminary examination by it, it becomes apparent that this institution is indeed bent on interfering with the sovereignty of our Republic even if it means disregarding the Rome Statute, the very instrument which created it,” ani Panelo.

Umatras na ang bansa sa pagiging miyembro ng ICC matapos simulan ang preliminary examination sa madugong war on drugs ni Duterte.

Pero ayon sa Pangulo at sa Palasyo, walang hurisdiksyon ang ICC sa Pilipinas dahil hindi napublish sa Official Gazette ang ratipikasyon ng Rome Statute, ang treaty na bumuo sa ICC.

“Even if we assume, for the sake of argument, that the Rome Statute became enforceable in the Philippines, the ICC can still no longer exercise its powers over the country as, in such hypothetical case, our withdrawal already became effective last month,” dagdag ni Panelo.

Giit pa ng opisyal, pwede lang ituloy ng ICC ang kaso kung nagkaroon ng criminal investigation bago naging epektibo ang pagkalas ng bansa sa naturang international court.

Ayon pa kay Panelo, dahil sa may kinikilingang aksyon ng ICC, hindi maiiwasang isipin na may halong pulitika ang aksyon ng korte na layong sirain hindi lang ang administrasyon kundi pati ang Pangulo.

Ang reklamo ng NUPL na tinatawan na communication ay ikalawang complaint laban kay Duterte, una ang inihain ni Atty. Jude Sabio noong April 2017.
