Omnibus motion inihain para ipasuspinde ang warrant of arrest laban kay Nicko Falcis

Naghain ng omnibus motion ang kampo ni Nicko Falcis para ipasuspinde ang nakatakdang pag-aresto laban sa kanya.

Ito ay makaraang ilabas ni Taguig City Regional Trial Court Judge Felix Reyes ang warrant of arrest laban kay Falcis dahil sa umano’y paglabag sa Access Device Regulation Act.

Sa statement kahapon (March 15) ni Regi Ponferrada abogado ni Falcis, sinabi nitong naghain sila ng mga kahalintulad na mosyon sa Municipal Trial Court Branch 177 at Regional Trial Court Branch 70 sa kaparehong lungsod.

“We filed an Omnibus Motion before Branch 117 of the Municipal Trial Court of Taguig City, wherein we prayed for leave of court to file a Motion for Preliminary Investigation, for suspension on the ground of existence of a prejudicial question in a civil case,” ani Ponferrada.

Ayon kay Ponferrada, ang mosyon ay layong ibasura, ipagpaliban ang paglalabas o hindi kaya ay bawiin ang warrant of arrest sakaling walang makitang probable cause sa kaso.

Ang pagpapa-aresto kay Falcis ay matapos makitaan ng Taguig City prosecutor ng probable cause para isulong ang kasong ‘access device fraud’ at estafa na inihain ni Kris Aquino.

Nauna nang ibinasura ng mga korte sa Makati at Pasig ang isinampang kaso ni Aquino laban kay Falcis sa pitong siyudad.
