Kasong administratibo laban kay dating CJ De Castro, ibinasura ng SC

Ibinasura ng Korte Suprema ang administrative case laban kay dating Chief Justice Teresita Leonardo-de Castro.

Ayon sa Supreme Court, walang sapat na ebidensya para patunayan ang alegasyon na inupuan umano ni De Castro ang isang kaso sa kabila ng deadline na itinakda ng batas at rules of court.

Ang desisyon ay sinulat ni Associate Justice Marvic Leonen at inilabas ng SC Public Information Office.

Si De Castro ay inakusahan nina Elvira N. Enalbes, Rebecca H. Angeles at Estelita B. Ocampo ng gross ignorance of the law, gross inefficiency, gross misconduct, gross dishonesty at conduct prejudicial to the best interest of the service.

Nag-ugat ito sa umanoy kabiguan ni De Castro na magdesisyon kahit lampas na ng mahigit 5 taon ang mga petisyon ng mag-asawang Eligio P. Mallari at Marcelina I. Mallari noong 2012 at 2013.

Pero ayon sa Korte Suprema, sa ilalim ng 1987 Constitution at Internal Rules of Court, ang “reckoning” ng 24-month period ay nagsisimula lamang kung naisumite na ang huling pleading ukol sa kaso.
