Mosyon ng Rappler kontra SEC ibinasura ng Court of Appeals

Pinagtibay ng Court of Appeals ang nauna nilang desisyon noong 2018 na nagsasabing hindi 100 percent Fililipno-owned ang online news outfit na Rappler.

Sa kanilang 25-pahinang desisyon, sinabi ng 12th division ng appelate court na kanilang ibinabasura ang motion for reconsideration na isinumite ng Rappler at ng Rappler Holding Corp. noong Agosto ng nakalipas na taon.

“After a careful scrutiny of the instant motion, this Court finds that it presents no compelling reason to justify the reconsideration of this Court’s decision dated 26 July 2018. The arguments raised by petitioners are essentially the same as those that have already been discussed and were exhaustively passed upon in this Court’s decision,” ayon sa isinulat na desisyon ni Associate Justice Rafael Antonio Santos.

Sinabi ng hukuman na walang merito ang inihaing mosyon ng Rappler.

Nilinaw rin ng CA na walang ginawang paglabag sa security laws ang Securities and Exchange Commission (SEC) nang ibasura nila ang business registration ng Rappler ilan taon na ang nakalilipas.

“While there is no denying that a full compliance with the procedure under the 2016 SEC Rules was not observed by the SEC, a substantial compliance with the requirements of procedural due process was clearly accorded to the petitioners. Therefore, the Court maintains that the assailed SEC en ban decision cannot be annulled on the ground that petitioners were denied due process,” Ayon pa sa desisyon ng CA.
