Court of Appeals hindi naglabas ng TRO na pipigil sa paghirang ng 3rd telco

Hindi nagpalabas ang Court of Appeals ng temporary restraining order na pipigil sa proseso ng bidding para sa hihiranging 3rd telco sa bansa.

Sa halip na mag-isyu agad ng TRO ay inatasan ng CA Special 12th Division na maghain ng paliwanag ang National Telecommunications Company o NTC.

Pinasasagit ng CA ang NTC sa petition ng NOW Telecom na kumukuwestiyon sa resulta ng isinagawang bidding kung saan napili ang Mislatel Consortium bilang 3rd Telco player.

Binigyan ng sampung araw ng appellate court ang NTC upang isumite ang komento at mga legal na pinagbatayan kung bakit napili ang Mislatel bilang ikatlong major players sa telecommunication ng bansa.

Una rito ay dumulog kay Manila RTC Branch 42 Judge Dinnah C. Aguila-Topacio, upang mapatigil ang bidding sa nasabing proyekto ng NTC ngunit binasura lamang ng hukom ang petisyon ng NOW Telco.
