Acting CJ Carpio: Same-sex union “constitutional”

Sinabi ni Supreme Court Acting Chief Justice Antonio Carpio na ‘constitutional’ ang same-sex union.

Sa interpelasyon kay Solicitor General Jose Calida sa ikalawang bugso ng oral arguments ng SC sa nasabing usapin, sinabi ni Carpio na ang same-sex civil union ay isang constitutional right sa ilalim ng freedom of association.

Sinabi ni Carpio kay Calida na maaaring magkaroon ng civil agreements sa pagitan ng same-sex partners kabilang na ang kasunduan sa pamana at paglilibing.

“Can two people of the same sex agree that their property relations will be governed by absolute community of property, they can also agree that when I die you will inherit they can agree that when I die, you will decide where I will be buried? Of course, because even without a law, that will be constitutional,” ani Carpio.

Ang naturang mga kasunduan na ‘konstitusyonal’ ay hindi naman anya salungat sa argumento ni Calida na ang kasal ay sa pagitan ng lalaki at babae lamang.

Ayon sa acting Chief Justice, bagaman ang kasal ay para lamang sa lalaki at babae kung ikukunsidera ang aspetong pangkasaysayan, biblikal, at panlipunan, maaari namang magkaroon ng ‘union’ na isang bagong ‘development’ para sa same sex couples.

Inihayag naman ni Calida ang pagrespeto sa posisyon ni Carpio.

Samantala, sinabi naman ni Atty. Jesus Falcis III na siyang petitioner ng isyu na pinag-aaralan na ng kanilang kampo na ikonsidera ang ‘civil union’ bilang ‘middle ground’.
