Hiling ni Napoles na mailipat siya sa kostodiya ng WPP, ibinasura ng Sandiganbayan
Ibinasura ng Sandiganbayan ang kahilingan ng tinaguriang pork barrel scam queen na si Janet Lim-Napoles na siya ay makalaya mula sa pagkakabilanggo sa Camp Bagong Diwa at mailipat sa kostodiya ng Witness Protection Program (WPP)
Sa apat na pahinang resolusyon ng 1st division ng atni-graft court sinabi ng korte na ibinasura na rin nila noon ang bail petition ni Napoles kaugnay sa P224.5-million plunder case ni Senator Bong Revilla.
Ayon sa Sandiganbayan, ang pagsasailalim sa kaniya sa protective custody bilang bahagi ng WPP ay malinaw na taliwas sa kahalagahaan ng isinasaad ng Article XI, Section 1 ng 2012 implementing rules and regulations ng Witness Protection, Security and Benefit Act.
“The Program shall not take into protective custody a witness who is under detention for any lawful cause. However, it shall direct the custodian of the witness to take necessary measures to ensure the safety and security of the witness.” Bahagi ng nasabing probisyon.
Mas binigyang bigat ng korte ang argumento ng mga prosecutor ng Office of the Ombudsman na tumutuol sa hiling ni Napoles.
Ang resolusyon ng Sandiganbayan ay isinulat I Associate Justice Efren N. de la Cruz at nilagdaan din nina Associate Justices Geraldine Faith A. Econg at Edgardo M. Caldona.
Tanging ang hirit ni Napoles na makalabas ng bilangguan at mailipat sakostodiya ng WPP ang sakop ng ruling ng Sandiganbayan.
Anomang hakbang ng DOJ hinggil sa pagtanggap sa kaniya sa WPP o kung gagawin man siyang testigo sa pork barrel scam cases ay hindi sakop ng desisyon.
