Gobyerno, Kongreso, pinasasagot sa lump sum sa 2015 budget
Pinasasagot ng Korte Suprema ang gobyerno at ang kongreso sa mga alegasyong may lump sum at discretionary fund pa rin na napapaloob sa 2015 National Budget.
Sa sesyon kahapon inatasan ng mga Justices ang pamahalaan ang Executive at Legislative branch na mag-komento sa petition for Temporary Restraining Order na inihain ng Philippine Constitution Association o Philconsa.
Sa petisyon ng Philconsa, hiniling nito sa SC na magpalabas ng TRO sa implementasyon ng Section 65, 70 at 73 ng 2015 General Appropriations Act at maging sa Special Purpose funds.
Hiniling din ng grupo sa SC na mag-issue ng show cause order laban sa Kongreso at kay Budget Secretary Florencio Butch Abad dahil sa paglabag ng mga nito sa kautusan ng Korte Suprema sa usapin ng paggamit ng Priority Development Assistance Fund at Disbursement Acceleration Program.
Una na ring hiniling ng Philconsa na ideklara ng SC na unconstitutional ang tatlong probisyon na nasa ilalim ng 2015 GAA. Argumento ng Philconsa, may P424 na bilyong pisong lump sum appropriations na nakapaloob sa GAA sa siyam na strategic departments at dalawang executive agencies na maaring magamit sa patronage politics.
Sa kabila ng katotohanang malapit nang matapos ang taon, posible pa rin aniyang mapigil ng KOrte SUprema ang paglalabas ng mga kuwestyunableng pondo.
